This Privacy Policy explains how TEXPEPS(“TEXPEPS Health,” “we,” “us,” or “our”) collects, uses, and shares information through our marketing website at texpeps.com(the “Site”). It also explains the important distinction between our informational pages, which do not collect health information, and our secure intake, where health information is collected and protected under HIPAA.
The most important thing to know first
Our informational pages do not collect health information. The pages you browse here are for education and general information. We intentionally do not ask for — and you should not enter — symptoms, conditions, medications, weight, lab values, dosing, or any other health details on these pages.
Health information is collected only when you choose to begin our secure intake at /start. What you enter there is protected health information (PHI): it is transmitted securely and processed by Qualiphy PC, our clinical and e-prescribing platform. We require a Business Associate Agreement with any vendor before it processes protected health information on our behalf. After you submit those first details you are redirected to Qualiphy to complete your consultation, so the remainder of the clinical experience happens on their site under their privacy practices. Your eligibility responses, clinical review, e-prescribing, checkout, and records are handled on that platform. The secure intake carries no advertising or analytics trackers. Information we collect on our informational pages
Outside the secure intake, we collect only limited, non-health information:
- Contact form details. If you contact us, we collect your name, email address, and the contents of your message. Please do not include health details in a contact message; if you have a clinical question, begin the eligibility check so it can be handled on the secure platform.
- Basic analytics and usage data. Like most websites, we collect standard, privacy-respecting analytics such as pages viewed, approximate (city/region) location derived from IP address, device and browser type, referring website, and general interaction events. This helps us understand what content is useful and improve the Site.
- Technical and security data. Server logs may record IP address, timestamps, and request details to operate the Site securely and prevent abuse.
We do not collect Social Security numbers or financial account numbers on our informational pages. Payment and your full clinical record are handled on the Qualiphy clinical platform; the only health information collected on this Site is what you enter on the secure intake described below.
Cookies and similar technologies
We use cookies and similar technologies to operate the Site, remember basic preferences, and measure traffic. Analytics cookies help us count visits and understand how pages perform. You can control or block cookies through your browser settings; some parts of the Site may not function as intended if you disable them.
We deliberately keep advertising and tracking pixels that are not covered by a Business Associate Agreement off of any page that could involve health information. The clinical/intake funnel is kept free of non-BAA marketing trackers by design.
How clinical intake and health records are handled
TEXPEPS connects patients with independent, licensed providers and U.S.-licensed pharmacies. When you begin our secure intake, the health information you enter is transmitted securely to Qualiphy PC, our clinical and e-prescribing platform, which we require to operate under a Business Associate Agreement. The clinical experience — eligibility, intake questionnaire, provider review, e-prescribing, checkout, and pharmacy fulfillment through the e-prescribing and pharmacy services that platform integrates — is handled on that platform.
- Your protected health information (PHI) is processed and stored under HIPAA safeguards. We collect it only on the secure intake and only to provide your care — never on our informational pages.
- The secure intake carries no advertising or analytics trackers. We do not use PHI for marketing.
- Once your information reaches the clinical platform and your treating provider, their privacy practices and any applicable Notice of Privacy Practices also govern that information.
How we use information
- To operate, maintain, secure, and improve the Site.
- To respond to your inquiries and provide customer support.
- To measure and analyze general Site usage and content performance.
- To send you information you request and, where permitted, occasional updates you may unsubscribe from at any time.
- To comply with legal obligations and enforce our terms.
How we share information
We do not sell your personal information. We share limited information only as needed:
- Service providers / processors. We use vendors that help us run the Site — for example, web hosting, analytics, and email delivery — who process information on our behalf under contractual confidentiality and security obligations.
- Clinical platform partner. Health information you enter on our secure intake is processed by Qualiphy PC, our clinical and e-prescribing platform, together with the pharmacy and e-prescribing services it integrates. We require a Business Associate Agreement with each vendor that handles protected health information.
- Legal and safety. We may disclose information if required by law, to respond to lawful requests, or to protect the rights, safety, and security of users and the public.
- Business transfers. If our business is involved in a merger, acquisition, or asset sale, information may be transferred as part of that transaction, subject to this Policy.
Data retention
We keep marketing-site information only as long as needed for the purposes described here — for example, to respond to your inquiry, maintain analytics, meet legal and accounting requirements, and protect against fraud — after which we delete or de-identify it. Health information collected on the clinical platform is retained under that platform’s policies and applicable healthcare recordkeeping laws, which differ from marketing-site retention.
Your choices and rights
Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of certain processing, and to not be discriminated against for exercising these rights. You can also:
- Unsubscribe from marketing emails using the link in any message.
- Adjust cookie and tracking settings in your browser.
- Contact us to make a privacy request; we will verify and respond as required by applicable law.
Requests about health information held on the clinical platform — including HIPAA rights such as access to your records — are handled through that platform’s processes; see HIPAA Information.
Children’s privacy
The Site is intended for adults. Our services are not directed to children, and we do not knowingly collect personal information from anyone under 18 through the marketing Site. If you believe a child has provided us information, please contact us so we can delete it.
Security
We use reasonable administrative, technical, and physical safeguards to protect information on the Site. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. For health information, the clinical platform applies HIPAA-grade safeguards described on our HIPAA Information page.
Changes to this Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above. Material changes will be reflected on this page, and your continued use of the Site after an update means you accept the revised Policy.
