These Terms of Service (“Terms”) are a binding agreement between you and TEXPEPS(“TEXPEPS Health,” “we,” “us,” or “our”) governing your access to and use of our website at texpeps.comand our services (together, the “Service”). Please read them carefully.
1. Acceptance of these Terms
By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of another person, you represent that you are authorized to do so.
2. What TEXPEPS is — and is not
TEXPEPS operates a technology platform that helps connect patients with independent, licensed healthcare providers and with U.S.-licensed compounding pharmacies (503A patient-specific and/or 503B FDA-registered outsourcing facilities) for evaluation and, where appropriate, treatment and fulfillment.
- TEXPEPS is not a pharmacy, a manufacturer, or a medical practice, and does not practice medicine or pharmacy.
- Providers who evaluate patients are independent professionals, licensed in the patient’s state, who exercise their own clinical judgment. They are not employed by TEXPEPS to direct care.
- Medications are dispensed by independent U.S.-licensed pharmacies, not by TEXPEPS.
3. Eligibility and age
You must be at least 18 years old and located in a U.S. state where the relevant services are available to use the Service. Service availability varies by state, and access depends on your state of residence and applicable law. You agree to provide accurate, current, and complete information.
4. No doctor-patient relationship with TEXPEPS
Using this website does not create a doctor-patient relationship between you and TEXPEPS. Any clinical relationship is between you and the independent licensed provider who reviews your information on the clinical platform. The marketing website itself provides general information only.
5. Not medical advice
Content on the Service is for general informational and educational purposes and is not medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, and see our Medical Disclaimer. Never disregard or delay seeking professional advice because of something you read on the Service.
6. Clinical review, prescriptions, and outcomes
- A treatment is available only if an independent licensed provider determines, in their clinical judgment, that it is appropriate for you after reviewing your information.
- A prescription is never guaranteed. Submitting an intake does not entitle you to a prescription or to any particular medication or dose.
- Individual results vary, and no specific outcome, result, or weight-loss amount is promised or guaranteed.
7. Compounded medications
Where treatment involves compounded medications, you acknowledge that compounded drugs are not FDA-approved and have not been reviewed by the FDA for safety, effectiveness, or quality. Compounded medications are a lawful, regulated category made by U.S.-licensed pharmacies or FDA-registered outsourcing facilities, but they are not equivalent to, and should not be assumed to be the same as, any brand-name FDA-approved product. 8. Payment
- TEXPEPS does not collect payment from you. This website has no cart, no checkout, and no payment processor. We do not charge you, store your payment details, or operate any billing or subscription arrangement with you, and nothing on this site can be purchased.
- No payment is taken before a consultation. You are not asked for payment information in order to submit an intake or to be seen by a provider.
- No charge for medication arises unless a provider prescribes. Any amount payable for a prescribed medication is charged only after an independent licensed provider has determined that treatment is appropriate for you. If no prescription is issued, there is nothing to pay for a medication.
- Where an amount is payable, it is presented to you by the clinical platform or by the dispensing pharmacy at the time it applies, together with that party’s own billing, refund, and cancellation terms, including any recurring or refill arrangement you choose to enter into with them. Those terms are between you and that party. Applicable taxes and fees may apply.
- Because prescription medications are personal and cannot be resold once dispensed, certain charges may be non-refundable to the extent permitted by law.
9. Acceptable use
You agree not to:
- Provide false, misleading, or another person’s information, or impersonate anyone.
- Use the Service for any unlawful purpose or to obtain medication for resale, diversion, or anyone other than yourself.
- Attempt to disrupt, reverse engineer, scrape, overload, or gain unauthorized access to the Service or its systems.
- Infringe the rights of others or violate any applicable law or regulation.
10. Intellectual property
The Service, including its text, design, logos, graphics, and software, is owned by TEXPEPS or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our prior written permission.
11. Third-party services and links
The Service relies on and may link to third parties, including Qualiphy PC, the clinical and e-prescribing platform that processes the intake you submit, and the independent providers and pharmacies in its network. We are not responsible for the content, products, or practices of third parties, and your use of their services is governed by their own terms and policies.
12. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular health outcome will result from its use.
13. Limitation of liability
To the fullest extent permitted by law, TEXPEPS and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid to TEXPEPS for the Service in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnification
You agree to indemnify and hold harmless TEXPEPS from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where a mandatory consumer-protection or healthcare law of your state applies. The governing-law and dispute-resolution provisions should be confirmed by counsel and aligned with the entity’s actual jurisdiction before publication.
16. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above, and material changes will be reflected on this page. Your continued use of the Service after an update means you accept the revised Terms.
